CHAPTER 1 PROMOTION CONDITIONS
- Definitions
- 1 In these promotion conditions, the following terms are defined as below, unless explicitly stated otherwise:
- SportSupport: the user of these promotion conditions: SportSupport Europe B.V. is established at Innovatiepark 38 in Oosterhout, the Netherlands, and registered with the Chamber of Commerce under Chamber of Commerce number 77677684;
- participant: the buyer who takes part in the promotion;
- promotion: the promotion as described in Article 3 of these promotion conditions;
- agreement: the agreement between the participant and SportSupport to participate in the promotion;
- product: the product of the “Eurosport nutrition” brand of SportSupport, such as Energy Bars, Oat Bars, Energy Gels, Isotonic Sports Drinks, Recovery Shakes, Protein Bars, Protein Shakes;
- buyer: the natural person who bought the product;
- personal data: data that can be used to identify a natural person;
- website: the website eurosportnutrition.com/win which is managed by SportSupport and where you can participate in the promotion;
- winner: the participant who has won a prize.
- 2 Unless the context indicates otherwise, terms defined in the singular also refer to the plural and vice versa.
- 1 In these promotion conditions, the following terms are defined as below, unless explicitly stated otherwise:
- General
- 1 These promotion conditions apply to the agreement.
- 2 If one or several of the provisions of these promotion conditions are void or voided, the other provisions of these promotion conditions will retain their full effect. The void or voided provisions will be replaced by SportSupport, duly observing the objective and purport of the original provision(s) as closely as possible.
- The promotion
- 1 The promotion means that the buyer of a product can upload his purchase receipt of the product on the website and that the winners – who receive a prize from SportSupport – are drawn from the participants.
- 2 By uploading the purchase receipt, filling in the requested information and confirming that the buyer agrees to these promotion conditions, the agreement is concluded and the buyer becomes a participant.
- 3 If the name of the retailer where the participant purchased the product or the name of the product is not clearly visible on the downloaded purchase receipt, SportSupport has the right to exclude the participant from participating in the promotion.
- 4 Only one participation per purchase receipt.
- 5 Participation in the promotion is excluded for employees ofSportSupport.
- 6 All information that the participant provides to SportSupport during the conclusion of the agreement must be correct and complete.
- 7 After the agreement has been concluded, SportSupport will send the participant a confirmation by e-mail.
- 8 The purpose of the promotion is, among other things, to promote the products.
- 9 In addition to the usual costs associated with Internet use, no additional costs will be charged for participation in the promotion.
- Prize winners will be notified by e-mail.
- If the winner has given permission to SportSupport for this, SportSupport will disclose the name of the winner to the retailer where the winner purchased the product and this retailer can state online, stating the name of the winner, that the winner purchased the product from the retailer.
- No correspondence can be entered into about the result of the promotion.
- The prize is awarded exclusively to the winner and cannot be exchanged for cash at SportSupport.

- 1 For questions or complaints about the promotion, the participant can contact SportSupport as follows:
- 2 Participants can communicate with SportSupport in Dutch or English.
- 3 If the participant has submitted a complaint via e-mail, SportSupport will send the participant an e-mail to confirm receipt of the complaint as soon as possible.
- 4 Complaints will be handled by SportSupport as soon as possible. The participant will receive a substantive response from SportSupport regarding the complaint within 14 days of SportSupport receiving the complaint. If SportSupport is unable to provide the participant with a substantive response within 14 days, the participant will be notified by e-mail and SportSupport will inform the participant within which period the latter can expect a substantive response.
- 5 A complaint must be properly motivated by the participant. SportSupport has the right not to handle complaints that are not properly motivated.
- Liability
- 1 Due to a failure, the website may temporarily not function or not function properly. SportSupport is not liable if it is not possible to participate in the promotion due to a website failure.
- 2 SportSupport is not liable for damage, of whatever nature, because SportSupport has assumed incorrect and/or incomplete information provided by the participant, such as an address or e-mail address incorrectly entered by the participant.
- Applicable law and competent court
- 1 These promotion conditions are governed by Dutch law.
- 2 All disputes between the participant and SportSupport will be settled by the competent court in the Netherlands within whose jurisdiction SportSupport has its business address. After SportSupport has invoked this stipulation in writing against the participant, the participant has 1 month to select the competent court according to the law to settle the dispute.
CHAPTER 2 PRIVACY
- Personal data, basis and purposes
- 1 SportSupport considers due care in handling personal details of paramount importance. With regard to the processing of personal data, SportSupport acts in accordance with the applicable laws and regulations.
- 2 SportSupport handles personal data with care and treats it in confidence.
- 3 SportSupport collects personal data from the participant when the participant has provided this personal data to SportSupport via the website.
- 4 The basis for the processing of the personal data is the performance of the agreement or consent to the processing of personal data if this is requested from the participant.
- 5 When participating in the promotion, the following personal data of the participant may be processed:
- First name and surname;
- Address;
- Postcode, place and country of residence;
- Telephone number;
- E-mail address;
- Date of birth;
- 6 SportSupport does not process special personal data of participants.
- 7 SportSupport collects and processes the personal data for the following purposes:
- Being able to address the participant with his name;
- Dealing with questions and/or comments from the participant;
- Concluding the agreement;
- Announcing the winner and the dealer where the winner purchased the product;
- Being able to contact the participant;
- Sending the prize to the winner;
- Fulfilling administrative duties;
- Sending the participant a newsletter, if he has given permission for this, see also Article 8;
- Generating general statistics on product sales;
- Improving the services of SportSupport.
- 8 Under the agreement, the participant is obliged to provide his name, address, e-mail address, gender, date of birth and favourite sport he practises. You cannot participate in the promotion without providing you name, address, e-mail address, gender and date of birth.
- 9 SportSupport does not intend to collect data about participants under the age of 16, unless they have permission from a parent or legal representative. However, SportSupport cannot check whether a participant is older than 16. SportSupport therefore advises parents and legal representatives to be involved in the online activities of their children, to prevent data about children from being collected without parental consent. If a parent or legal representative is convinced that SportSupport has collected personal information about a minor without such permission, the parent or legal representative should contact SportSupport using the contact details provided in Article 4.1 andSportSupport will end processing and delete the personal data.
- SportSupport will not keep the personal data longer than is strictly necessary to achieve the goals described in Article 7.7, for which the personal data is processed.
- SportSupport only processes the minimum personal data required for the existing purposes. SportSupport aims to process as little personal data as possible.
- SportSupport will not process personal data for purposes other than described above.
- Newsletters
- 1 Newsletters will only be sent to the participant if the participant has given explicit unambiguous consent to SportSupport for this. The participant can unsubscribe from newsletters at any time, see Article 9.
- 2 SportSupport will not approach the participant for direct marketing purposes if the participant has not given permission for this.
- Unsubscribing from newsletters
- 1 The participant can unsubscribe from newsletters in the following ways:
- By clicking on the link in the e-mail containing the newsletter, which link allows the participant to unsubscribe from such newsletters;
- By contacting SportSupport, see Article 4.1 for the contact details.
- 2 Every newsletter that is sent to the participant contains a link by which means the participant can unsubscribe from the newsletters.
- 1 The participant can unsubscribe from newsletters in the following ways:
- Security
- To prevent unauthorised access to the participant’s personal data, loss, theft and unlawful use of personal data, SportSupport has taken various security measures, including measures against unauthorised access, use, changes, unlawful and unintended destruction and unintended loss of the participant’s personal data. Among other things, SportSupport has taken the following security measures:
- Using systems with strong passwords to prevent unauthorised access to information systems and which are only accessible to management and administration;
- Using secure network connections;
- Data provided to SportSupport is stored on a separate server in a closed space through a secure web environment;
- Encrypted storage of the data in the database;
- Periodically checking the security measures taken;
- Timely software updates and backups on external, disconnected secure data carriers;
- E-mail messages and/or other documents that contain personal data of the participant are generally not printed. If something is printed off, the document will be kept in a locked cabinet in a locked room or the document will be destroyed immediately after use;
- Physical protection of its IT facilities and equipment against unauthorised access and damage and malfunction.
- To prevent unauthorised access to the participant’s personal data, loss, theft and unlawful use of personal data, SportSupport has taken various security measures, including measures against unauthorised access, use, changes, unlawful and unintended destruction and unintended loss of the participant’s personal data. Among other things, SportSupport has taken the following security measures:
- Deletion of personal data
- SportSupport will delete personal data from its systems without unreasonable delay if, for instance:
- The personal data is no longer required for the purposes for which it was processed;
- The participant objects to his data being processed and this objection is justified;
- The personal data is incorrect or superseded.
- SportSupport is not obliged to delete personal data if it concerns one of the situations described in the law in which the “right to oblivion” does not apply.
- SportSupport will delete personal data from its systems without unreasonable delay if, for instance:
- Disclosure of personal data to third parties
- SportSupport will not disclose the personal data of the participant to third parties until:
- SportSupport has received the explicit prior consent of the participant;
- One of the statutory principles applies under which the disclosure of personal data to third parties is permitted;
- The data is forwarded to a processor engaged by SportSupport for the purposes listed in this Chapter 2 “Privacy” of these promotion conditions, such as an ICT service provider, with which processor SportSupport has concluded an agreement that ensures that the processor offers sufficient guarantees with regard to technical and organisational security measures with regard to the processing to be carried out.
- The participant can withdraw his consent for his personal data to be disclosed to third parties at any time.
- SportSupport will not disclose the personal data of the participant to third parties until:
- Right to portability, rectification and deletion
- On request, SportSupport will grant the participant access to all personal data that SportSupport keeps about him and SportSupport will give the participant a free copy of this data in such a form so that the participant can provide the personal data to a third party.
- SportSupport offers the participant the opportunity to have any incorrect data that SportSupport keeps corrected or deleted free of charge.
- The request to change or delete data can be submitted to SportSupport in writing or by e-mail. See article 4.1 for the contact details of SportSupport. SportSupport will respond to such a request as soon as possible and in any case within 4 weeks.
- Objection
- The participant can object to the processing of his personal data at SportSupport if he has good reason given his specific situation. After SportSupport has received the objection from the participant, SportSupport will stop processing the participant’s personal data, unless SportSupports legitimate interests in the processing of personal data outweigh the interest of the participant.
- Right to restriction
- If the participant has submitted a request regarding the adjustment, supplementation or deletion of his personal data or if he has submitted an objection regarding the processing of his personal data and the handling, processing and execution of this request or that objection take some time, the participant can ask SportSupport to limit the processing of his personal data.
- Contact
- For questions about the way in which SportSupport processes personal data, about withdrawing consent with regard to the processing of personal data, access to personal data that SportSupport processes of the participant, a request for a copy of his personal data, a request to change or delete his personal data, the request to limit the processing of his personal data or the submission of an objection to the processing of his personal data, the participant can contact SportSupport via the contact details included in Article 4.1.
- If SportSupport corrects, supplements or deletes personal data of the participant at the request of the latter, or terminates or restricts the processing of the personal data or has processed a withdrawn consent, SportSupport will inform the participant.
- Changes
- SportSupport reserves the right to unilaterally make changes to this Chapter 2 “Privacy” of these promotion conditions.
- Data breach
- If a security incident has occurred at SportSupport in the course of which personal data of a sensitive nature has been leaked or which for any other reason has a serious adverse effect on the protection of the processed personal data, SportSupport will, if possible, report it to the Dutch Data Protection Authority within 72 hours of detecting the data breach and act in accordance with the Policy Rules on the duty to report data breaches of the Dutch Data Protection Authority.
- If there is a data breach at SportSupport that has unfavourable consequences for the privacy of the participant, SportSupport will immediately notify the participant.
- Submitting a complaint
- If the participant believes that the processing of personal data by SportSupport is not in accordance with these promotion conditions and/or with the applicable laws and regulations, the participant can submit a complaint to a supervisory authority, such as the Dutch Data Protection Authority.
