- person concerned: the natural person who (on behalf of a company) has entered into an agreement with Outdoor Fanatics, or the natural person who (on behalf of a company) has contacted Outdoor Fanatics regarding the conclusion and/or execution of the agreement or the natural person who (on behalf of a company) visits the website;
- agreement: the agreement between Outdoor Fanatics and the person concerned using the service offered by Outdoor Fanatics;
- website: the website https://eurosportnutrition.com/ which is managed by Outdoor Fanatics;
- profiling: the processing of personal data in which certain personal aspects of the person concerned are evaluated on the basis of personal data for the purpose of analysing or predicting his personal preferences, interests, online search behaviour and location;
- personal data: data that identifies a natural person.

Article 2. Personal data

- For Outdoor Fanatics careful handling of personal data is of great importance. With regard to the processing of personal data Outdoor Fanatics acts in accordance with the applicable laws and regulations.
- Outdoor Fanatics handles personal data carefully and treats it confidentially.
- Outdoor Fanatics collects personal data from the person concerned when the person concerned has provided this personal data to Outdoor Fanatics (via the website) or when the person concerned visits the website or has contacted Outdoor Fanatics by telephone or email.
- Outdoor Fanatics collects and processes the following personal data:
- first and last name;
- address;
- postal code, place of residence;
- bank account number;
- phone number;
- e-mail address;
- sex;
- date of birth;
- social security number;
- IP address;
- web-browsing behaviour;
- location data.
- Outdoor Fanatics does not process any special personal data of persons concerned.
- The website and/or service has no intention of collecting data on persons concerned under the age of 16 and without having the consent of a parent or legal representative. Outdoor Fanatics cannot verify that a person concerned is over 16. Outdoor Fanatics therefore advises parents and legal representatives to be involved in their children’s online activities in order to prevent data on children being collected without parental consent. If a parent or legal representative is certain that Outdoor Fanatics has collected personal data of a minor without consent, the parents or legal representatives should contact Outdoor Fanatics using the contact information included in article 12.1 and Outdoor Fanatics will terminate the processing and delete the personal data.
Article 3. Basis and purposes of processing
- The basis for the processing of personal data is the execution of the agreement or, at the request of the person concerned, the taking of pre-contractual measures. In the case of profiling, this is with the consent of the person concerned.
- Outdoor Fanatics collects and processes the personal data for the following purposes:
- dealing with a question and/or comment by the person concerned;
- the making of a quotation and/or offer to the person concerned;
- the establishment of the agreement;
- in order to be able to contact the person concerned with regard to the execution of the agreement;
- executing the agreement;
- maintaining a customer relationship with the person concerned;
- building and maintaining a customer base;
- sending an invoice;
- compliance with administrative duties;
- to offer the person concerned personalised advertisements and content (profiling), see also article 4;
- to send a newsletter to the person concerned, if he has given his consent, see also article 5;
- to improve the website and service of Outdoor Fanatics;
- generating general statistics on the use of the website.
- The provision of the name, address, telephone number and e-mail address of the person concerned is a contractual obligation. Without the name, address, telephone number and e-mail address, no agreement can be reached.
- Outdoor Fanatics will not retain the personal data for longer than is strictly necessary in order to achieve the objectives, as defined in article 3.2, for which the personal data are processed.
- Outdoor Fanatics only processes the personal data that are at least necessary for the existing purposes. Outdoor Fanatics strives for minimal data processing.
- Outdoor Fanatics will not process the personal data for purposes other than those described above.
Article 4. Profiling

- Profiling is only carried out if the person concerned has given permission to Outdoor Fanatics. This permission may be withdrawn by the person concerned at any time.
- The purpose of profiling is:
- showing the person concerned on the website advertisements or other content that Outdoor Fanatics suspects that the content of the advertisement or content is in accordance with the interests of the person concerned;
- marketing analysis;
- sending a personalised newsletter.
- Profiling can be done by combining the data provided by the person concerned when creating an account and data from different cookies.
- For profiling purposes, Outdoor Fanatics may process the following data:
- sex;
- age;
- location data;
- search commands entered on the website;
- web-browsing behaviour.
Article 5. Newsletters

- Newsletters shall only be sent to the person concerned if the person concerned has expressly given unambiguous consent to Outdoor Fanatics. The person concerned may opt out of newsletters at any time, see article 6.
- Outdoor Fanatics will not approach the person concerned for direct marketing purposes if the person concerned has not given his consent.
Article 6. Opt out of newsletters

- The person concerned may opt out of newsletters in the following ways:
- by clicking on the link in the e-mail in which the newsletter is included, which allows the person concerned to opt out of such newsletters;
- by contacting Outdoor Fanatics, see article 12.1 for contact information.
- Each newsletter sent to the person concerned will include a link with which the person concerned can opt out of the newsletters.
- The person concerned may opt out of newsletters in the following ways:
Article 7. Deleting personal data

- Outdoor Fanatics will remove personal data from its systems without unreasonable delay if:
- personal data are no longer necessary for the purposes for which they have been processed;
- the person concerned objects to the processing of his personal data and this objection is justified;
- personal data are incorrect or outdated.
- Outdoor Fanatics is not obliged to delete personal data if there is one of the situations defined in the law where the “right to be forgotten” does not apply.
- Outdoor Fanatics will remove personal data from its systems without unreasonable delay if:
Article 8. Provision of personal data to third parties

- Outdoor Fanatics will not provide the personal data of the person concerned to third parties before:
- Outdoor Fanatics has expressly obtained prior authorisation from the person concerned;
- one of the legal bases applies to which the provision of personal data to a third party is permitted;
- it is necessary to execute the agreement;
- the transfer is made to a processor engaged by Outdoor Fanatics for the purposes listed in this privacy policy, with which processor Outdoor Fanatics has concluded an agreement that ensures that the processor offers sufficient guarantees with regard to technical and organizational security measures with regard to the processing to be carried out.
- The person concerned may revoke his consent to provide personal data to third parties at any time.
- Outdoor Fanatics will not provide the personal data of the person concerned to third parties before:
Article 9. Right of inspection, right to transferability, rectification and removal

- On request, Outdoor Fanatics shall grant the person concerned access to all personal data that Outdoor Fanatics holds of him and Outdoor Fanatics shall provide free of charge the person concerned with a copy of this data in such form that the person concerned can provide the personal data to a third party.
- Outdoor Fanatics allows the person concerned to have any incorrect data that Outdoor Fanatics holds of him corrected or deleted free of charge.
- The request for access, modification or deletion of data may be submitted in writing or by e-mail to Outdoor Fanatics, see article 12.1 for the contact information of Outdoor Fanatics. Outdoor Fanatics will respond to such a request as soon as possible and at least within 4 weeks.
Article 10. Objection

- The person concerned may object to the processing of his personal data by Outdoor Fanatics if he has a good reason for doing so in view of his specific situation. After Outdoor Fanatics has received the objection from the person concerned, Outdoor Fanatics will stop processing the personal data of the person concerned unless Outdoor Fanatics has legitimate interests that outweigh the interests of the person concerned in the processing of personal data.
Article 11. Right of restriction

- If a request has been made by the person concerned in relation to the modification, supplementation or deletion of his personal data or an objection has been made in relation to the processing of his personal data and the processing and execution of this request or that objection takes some time, the person concerned may request Outdoor Fanatics to limit the processing of his personal data.

- If Outdoor Fanatics, at the request of the person concerned, modifies, corrects or deletes the personal data of the person concerned, or terminates or restricts the processing of the personal data, Outdoor Fanatics will inform the person concerned.
Article 13. Security measures
- In order to prevent access to personal data by unauthorized persons, loss, theft and unlawful use of personal data, Outdoor Fanatics has taken various security measures, including measures against unauthorized access, use, modification, unlawful and unintended destruction and unintentional loss of personal data.

- This privacy policy does not apply to third-party websites or applications, such as social media websites, which are connected to the website through links. Outdoor Fanatics accepts no responsibility or liability in relation to the way in which these websites handle personal data. Article 15. Changes

- Outdoor Fanatics reserves the right to unilaterally make changes to this privacy policy. The latest version of the privacy policy of Outdoor Fanatics can be found on the website.
Article 16. Data breach

- If Outdoor Fanatics has had a security incident in which personal data of a sensitive nature has been leaked or which, for any other reason, has a serious adverse effect on the protection of the processed personal data, Outdoor Fanatics will, if possible, report to the Data Protection Authority within 72 hours of the data breach and act in accordance with the Data Breach regulation of the Data Protection Authority.
